In Need of Clarification of Unfair Redundancy in Birmingham Council Jobs Row

Birmingham City Council has made the decision to outsource one part of their IT department to India.

Trade Unions are right to dispute the move, which breaches section 90 of the Employment Rights Act 1996 and would fall under unfair redundancy.

The act is shaped to prevent people from being made redundant when their role is to be performed by someone else.

However, there appears to be some conflict between contract and procurement and employment here.

By outsourcing posts, the Council are tendering a contract to be run by another company which allows a loophole in the law and for 70 people to be made redundant.

The only way is to pursue the issue through the courts, to get the purposive interpretation of the legislation and ensure that more councils do not follow suit.
